Board Candidates...

    BP, I don't know what the rumors were but I can tell you what I know after receiving a reply from Mr. Hofer after I emailed him my concerns about lack of time for member questions. I would love to just copy and paste the email answer but there is a disclaimer on it that tells me I cannot do that; that the email was intended only for me.

    So, to say in my own words:

    • In the past they found that two hours was adequate but if people (members) who haven't asked a question still have one, they will be allowed to ask it.
    • There are only a few times that the moderator (him) asks a question; one is after they are introduced and the second is called a "Lightning Round" to be sure that the candidates are knowledgeable about SC. That takes about 5 - 10 minutes.
    • We will be limited to one question.
    • The candidates are given two minutes to answer the question.
    • After everyone has asked their one question, a member may ask another.
    • They are not wanting someone to ask multiple questions or monopolize the event.
    • The Social 1/2 hour is where more questions can be asked.
    • After everyone has been given a chance to ask a question, the candidates get two minutes to make a closing statement.
    • After the event has ended and if the candidate is available, more questions can be asked then.
    This could present a problem if there are many excellent questions but only two or three members to ask them. They are not wanting someone to ask multiple questions.

    (Doesn't it seem like they would want lots of participation and lots of good questions from the membership so as to ensure that the best candidates for the members wins? Not!!)

    I've attended many of these over the years, mostly as a person asking a question, however one year i was in the "hot seat" answering them. Typically they have interspersed prepared questions by the moderator with questions from the floor. Usually there have been enough people in the room who wanted to ask questions and not have the same person asking multiples. I had heard they were going to incorporate some kind of online questioning. Not sure how that would work unless this will be a live zoom type feed.

    In years past, moderators have stopped some questions asked by those in the audience. For example, if there was a dispute going on in the community and someone asked how they would vote on the matter, they would not allow them to answer. Given what has gone on the past several months at board meetings, i expect they will be fairly rigorous in what is asked of the candidates.

    At the 10/11 board meeting Hoffer said the livestream would be on YOUTUBE. Someone will be watching comments for questions to be asked. He said they did a successful trial run over the summer.

    I'm not holding my breath on this one.

    I, too, received an email reply from Hoffer.
    Regarding the questioning format, he said, (paraphrasing)

    Candidates make opening comments

    Hoffer asks one question

    Then, anyone else waiting to ask a question,
    alternating between in person and YouTube questions.

    All member questions will be answered regardless of the two hour time limit.

    Hoffer sent me a follow up email after his original reply to mine. He just can’t stop talking or writing, can he?!

    My take away on what he wrote is that Members are really just “members without standing!”

    Paraphrasing what he wrote:
    Hoffer said to read Article V, Section 6 of the bylaws
    The Board serves the Corporation
    Board Members take an oath to give total loyalty to the RCSC
    Members vote for the Board & can run for the Board
    When elected, they do not represent the members, their function is only for the benefit of the RCSC Corporation
    “Member,” is not anywhere in the job duties of a Board Member

    Members are like “extras” in a RCSC movie…

    Who is the Corporation? The GM and staff? The board members?

    in my mind the corporation is the MEMBERS.

    I really hate to keep posting this, but given Mr. Hoffer's limited understanding of documents, i have no choice. EVERYTHING starts with the Articles of Incorporation, EVRYTHING!

    Here's the opening of Article 3, telling us the purpose for the organizations existence:
    ARTICLE III
    The general nature of the business in which the Corporation is engaged is as follows: To do anything and everything lawfully necessary in the interest of the Members of the Corporation, including, without limitation, the following.

    The purpose for the organization is to serve the members. All the other crap he spews in the By-Laws has to be in compliance with the Articles. I will tell you, they have taken brazen liberties in what they have written and have suborned the intent of the Articles by twisting all the other crap to serve management and the board. I know he reads this, i defy him to come on here and argue the point.

    Article 8 says this:
    4. The Bylaws may be amended, modified, revised, or revoked by the Directors or by the Members. In the event of conflict concerning the Bylaws as amended, modified, revised, or revoked by the Directors, the action of the Members shall prevail.

    Article 9 says this:
    B. The Members may remove any elected or appointed Director in the following manner, and any vacancy so created may be filled in the following manner:

    Article 13 says this:
    The Members of the Corporation shall be provided with the opportunity to vote by proxy in:

    a. Amending the Articles of Incorporation
    b. Members amending the Bylaws of the Corporation
    c. The election of Directors*
    d. Any other matter requiring an act of the members.

    Article 14 says this:
    An amendment to the Restated Articles of Incorporation may be proposed by resolution of the Board of Directors or by petition signed by at least ten percent (10%) of the total membership of the Corporation as of the first day of the preceding July. The proposed amendment shall be submitted to a vote of the Members at a regular or special meeting called pursuant to the provisions of the Bylaws.
    The proposed amendment shall be adopted or rejected by a majority vote of the Members, present or represented by proxy at such meeting or adjourned meeting.
    Written notice setting forth the proposed amendments or a summary thereof shall be given to each Member entitled to vote at the meeting within the time and in the manner provided in the Bylaws for the giving of notice of meeting.

    Let me be perfectly blunt here, the Articles of Incorporation were written in such a way to provide safeguards from exactly what has happened the past 15 years. Board members have aided the gm is moving away from those safeguards and diverting the power to the management and the board. I repeat, I DEFY DIRECTOR HOFFER TO STEP UP HERE AND DEFEND THEIR ACTIONS.

    From Joelyn Higgins (RCSC) with permission to share ...

    The RCSC Candidate biography document is currently available at the RCSC Corporate Office at Lakeview and will be available at all upcoming Board Meetings (next one is 10/28). It will be electronically available via the RCSC Web Portal once online voting begins November 8.
    In addition, I will be sending out an email blast with video introductions from each of the candidates by the end of the week and bio information will be in the November and December SunViews.

    Thanks for the notification.
    Just watched them.
    Listen closely…for who talks about MEMBERS, and importantly, who does not!
    Also, if you’re a subscriber, vote thumbs up on those you’re impressed with. I noticed an obvious trend already…none for McAdam while others already had three, hmmm! McAdam now has one from me…the “vote” isn’t associated with your name.

    He used to come here but he got pissy because i argued Sun City was built on a platform of ownership and a sense of community, too often. He went stalking off in a snit telling us all he was tired of me beating that drum...and by the way, why didn't we do a better job at the museum of the video we posted. One can only freaking smile; comparing an organization that has more money than they know what to do with (the RCSC) to the Museum that battles every day to keep our doors open.

    I have not yet gotten an email blast regarding the candidates. I do usually get email blasts.

    I found the link to the videos and really was not impressed at all by at least 6 of the candidates.

    Stella is a retread.

    Kat mentioned that we have self governance here. Have you seen it recently?

    Karen was thoughtful in her video not to bring up past disagreements with the board. She will get my vote.

    John did mention the number of bylaw changes over the past years. He's a possibility

    Frank - I gotta see a rerun of the video.

    Candace - gotta see a rerun.

    Alan - a golfer to be aware of. Did serve on LRPC.


    I may consider voting for 1 or 2 other candidates other than Karen, but overall I think the current crop of candidates is under whelming.

    Just my opinion folks. What the candidates did in the past really doesn't matter to me. It is what they will do if elected to t he board.

    Interesting to pay attention to the thumbs up and thumbs down counts…very revealing of who is paying attention! Seriously, there are thumbs downs being cast…by whom? I think we know!!

    I will have to wait for the 2 candidate forums to form a final decision.

    As of right now there is really only 1 candidate, but there are 4 open positions.

    Voting for a retread is out. Wasn’t thrilled with Stella when she was on the board.

    voting for a golfer is also out. Alan would have to read use himself from any vote remotely concerned about golf because of a conflict of interest.

    Waiting for the 2 forums.

    I would be beyond amazed to hear of Hoffer coming on here to speak in any kind of reference. He is a huge blowhard, and becomes beligerent when he doesn't get his way on these boards. I do know of him personally, and find him to be offputting and loud, especially when he is losing the gist or the point of the discussion. It is truly a shame he has had as many years on the board he has had, he is not deserving of any place of decision making and is clearly not a leader of perople.

    I would like to see the "veil" of secrecy lifted off of the board member candidates, as they are usually warned not to be heard or visible on a chat board. That is the constant message given to RCSC board members, to not participate with the boards or to make a statement or take a stand while serving. It will supposedly place a board member in legal jeopardy for expressing a personal opinion. Yet, it is okay for them to decide the very future of this community and how its members should be treated from behind closed doors, secret meetings, emails and texts. Which one of these sounds like a legal jeopardy to you? Definition of legal jeopardy from Dictionary.law.com ". n. peril, particularly danger of being charged with or convicted of a particular crime." With the amount of issues purportedly done by these directors with the willing accomplices at hand, the indemnity clause is not a saving grace for them, as they performed these functions knowlingy and with known recourse and malice.

    I am truly in favor of a forensic audit of the RCSC to be done as soon as possible, to ferret out all of the costs and charges not posted according to standard practices or IRS rules. This community needs the truth, and needs it delivered in a format that is honest and to the point.

    Watching the videos gave me a clear understanding of the three candidates I will vote for, leaving my up in the air on the fourth. I am grateful the candidates took this time to post these, as it is much better than reading the bio.
